Ordering a Company

How to order

1. Use the Name Search page to check the availability of the name.

2. Download the order form (which includes consent forms), complete the required details, have the proposed directors and shareholders sign the consents, and fax or post all forms to us. See the Payment Options page to choose a method of payment.

What happens next

If the preferred name is available, order form complete, consents signed and payment method approved we will register your company (normally in the next 3 business hours) and forward your company register the next business day after registration.

What does a standard company kit include

  • fully completed register with spare stationery
  • preparation of all necessary ASIC lodgements
  • deluxe A4 3 ring binder
  • bank account kit
  • 4 copies of Constitution

Company Types

Proprietary company

Order Form

These make up over 95% of all Australian companies. Suitable for trading, investment, trustee or any other legal activity. May have 1 or more directors, and 1 or more shareholders. Restricted to 50 members and restricted in the ways it can seek new investors in the company.

Public company

Order Form

The type of company needed to seek investment from the public. May have 3 or more directors, and 1 or more shareholders. Additional reporting requirements compared to a small proprietary company.

Non-profit company

Order Form

Non-profit (charity, religious, sporting, hobby, educational etc.) companies are normally a public company limited by guarantee. They require specific objects and clause to meet government requirements for preferential taxation treatment. May have 3 or more directors, and 1 or more members.

Super Fund trustee

Order Form

A company does not require any special provisions in its constitution to act as trustee of a superannuation fund.

However, if it wishes to be eligible for a reduced annual review fee it must be solely the trustee of a superannuation fund and have provisions in its constitution which prevent the distribution of income to its shareholders.
